Mock Brains AI Tool Stack

Terms of Sale

Last updated: [DATE TBD] Applies to: Mock Brains AI Tool Stack purchase and use

These Terms of Sale and the End User License Agreement govern your purchase and use of the Mock Brains AI Tool Stack setup scripts. By purchasing or using the product, you agree to these terms.

Placeholder notice

This page requires legal review and completion by Chad Davis before launch. The sections below are based on the legal research memo dated 2026-10-10 and outline recommended topics to address. Final terms should be reviewed by legal counsel before publication. Bracketed items require decisions.

1. Definitions

[CHAD: Define key terms. Recommended definitions from the memo:]

  • "Software" means the Mock Brains AI Tool Stack package you downloaded, including its scripts, Terraform configuration, configurator, installer, Docker Compose files, documentation, and any updates provided to you.
  • "Licensee" means the individual or single legal entity that purchased the license (and, for an entity, its employees and contractors acting for it).
  • "Third-Party Software" means any software the Software installs, configures, or depends on that is not authored by Mock Brains (including all applications listed in the deployment catalog).

2. What You Are Purchasing

The Mock Brains AI Tool Stack is a digital product containing setup scripts created by Mock Brains. It includes:

  • Terraform configuration files for Oracle Cloud Infrastructure
  • A browser-based configurator for customizing deployments
  • Installer scripts for deploying applications
  • Docker Compose files and related configuration
  • Documentation

The Third-Party Software applications (n8n, Ghost, Uptime Kuma, etc.) are NOT included in this purchase. They are separate projects with their own licenses, downloaded from their official upstream sources during installation. Mock Brains does not sell, distribute, license, or provide support for Third-Party Software.

3. License Grant (EULA)

[CHAD: Choose a license approach. The memo recommends a proprietary single-licensee EULA or PolyForm Internal Use 1.0.0. Key terms to include:]

  • Non-exclusive, non-transferable, non-sublicensable license
  • Install and run in unlimited cloud accounts owned/controlled by Licensee
  • Copy for installations and backup
  • Modify for Licensee's own use
  • [DECIDE: Personal use only, or internal business operations?]

4. Restrictions

[CHAD: Clearly state what is NOT permitted. Recommended restrictions:]

  • No copying, sharing, publishing, selling, reselling, or distributing the Software
  • No offering hosted/managed services using the Software to third parties
  • No including the Software in other products, templates, or bundles for sale/giveaway
  • No removing copyright notices or license identifiers
  • No building competing products that are substantially similar

[CHAD: If offering an Agency/Consultant tier, add separate terms allowing deployment into client-owned tenancies with specific limits.]

5. Third-Party Software and Services

The Software does not include any Third-Party Software. When you run the Software, it downloads Third-Party Software directly from its publishers. Each application is licensed to you by its publisher under its own terms, which you must read and follow.

Important license considerations:

  • Some applications (such as n8n and NocoDB) use the Sustainable Use License, which permits internal business use but restricts hosting as a service for others.
  • AGPL-licensed applications require you to share source code if you modify and provide network access to the software.
  • Some applications have paid tiers or enterprise features not included in their open-source versions.

You are solely responsible for compliance with Third-Party Software licenses and the terms of Oracle Cloud, domain registrars, email providers, LLM API providers, and any other services you use.

Mock Brains is not affiliated with, endorsed by, or sponsored by Oracle Corporation or any Third-Party Software publisher.

6. Your Responsibilities and Costs

You are responsible for:

  • Your Oracle Cloud account, credentials, and compliance with Oracle's terms
  • All API keys, passwords, and credentials you use
  • Data, backups, and disaster recovery
  • Security, patching, monitoring, and maintenance
  • Domain registration and DNS configuration
  • Email deliverability (SMTP relay services)
  • Setting budget alerts and monitoring your cloud billing dashboard
  • All fees, including any Oracle Cloud charges, domain costs, email services, LLM API usage, and any other third-party services

7. Limitation on Cloud Billing Claims

The Mock Brains AI Tool Stack is designed to deploy applications within cloud provider free tier resources. However, cloud providers control their own pricing, terms, free allowances, and service limits, which may change at any time without notice.

Customer acknowledges that:

  • Mock Brains has no control over Oracle Cloud Infrastructure or any other cloud provider's pricing, terms, free allowances, or availability;
  • Service limits displayed in a cloud console or CLI show what you MAY CREATE, not what is guaranteed FREE of charge;
  • Cloud provider documentation may contain conflicting information about free allowances (for example, Oracle's pages currently cite 2 OCPUs / 12 GB for Always Free tenancies and 4 OCPUs / 24 GB for paid tenancies);
  • Mock Brains makes no representation or warranty that any deployment will be free of charge;
  • Customer is solely responsible for setting budget alerts, monitoring billing dashboards, and paying all cloud provider charges; and
  • Mock Brains accepts no liability for any cloud charges, whether expected or unexpected, arising from Customer's use of the Software or any deployment created with it.

BY PURCHASING OR USING THIS PRODUCT, CUSTOMER AGREES TO THESE TERMS AND ACCEPTS ALL RISK OF CLOUD PROVIDER CHARGES.

[CHAD: This section reflects the approved disclosure wording. Have counsel review placement and enforceability.]

8. No Warranty

[CHAD: Include standard "AS IS" disclaimer. Recommended language from memo:]

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UPTIME, SECURITY, COST SAVINGS, OR THAT IT WILL WORK WITH ANY PROVIDER'S FREE OR PAID SERVICES.

[CHAD: Add consumer-law carve-outs for EU/UK/other jurisdictions as advised by counsel.]

9. Limitation of Liability

[CHAD: Include liability cap. Recommended from memo:]

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCK BRAINS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS, OR FOR CLOUD, THIRD-PARTY, OR SECURITY-INCIDENT COSTS.

MOCK BRAINS' TOTAL LIABILITY ARISING OUT OF THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM.

NOTHING EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

[CHAD: Review enforceability by jurisdiction with counsel.]

10. Delivery and Updates

[CHAD: Per the draft EULA, the product includes 12 months of updates. Confirm this matches your intended policy:]

  • Delivery: Instant download after purchase via my.mockbrains.com
  • Updates: 12 months of updates included from purchase date
  • After 12 months: [DECIDE: Paid renewal option? Price?]
  • Support: [DECIDE: Best-effort email? None? Paid tier?]

[CHAD: The marketing page and checkout now say "12 months of updates" to match the draft EULA. Adjust if needed, but ensure consistency across all materials.]

11. Refunds

See our Refund Policy for details on refund eligibility for this digital product.

12. Termination

[CHAD: Define termination conditions. Recommended from memo:]

  • Agreement ends automatically if you breach the Restrictions section
  • On termination, you must stop using and delete all copies of the Software
  • Your deployed Third-Party Software instances are governed by their own licenses
  • [DECIDE: Cure period for non-critical breaches?]

13. General Terms

[CHAD: Include standard general terms:]

  • Governing law: [STATE/COUNTRY]
  • Venue: [COURTS]
  • Entire agreement: This agreement supersedes prior agreements
  • Assignment: You may not assign without consent
  • Severability: Invalid provisions do not affect the rest
  • Waiver: Failure to enforce is not a waiver
  • Changes: [How you will notify of updates]
